1. Acceptance of Terms
By accessing or using bna-app ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the App.
2. Description of Service
bna-app is a platform that connects customers with local businesses. It provides business listings, messaging, event information, and security (SOS) features. The App is developed by KardosHost — Digital Solution.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years of age to use the App.
4. Business Listings
Business owners are solely responsible for the accuracy and legality of their business listings, including descriptions, images, pricing, and menu information. The App operator does not verify or endorse any business listing.
We reserve the right to remove, delist, or suspend any business listing without notice where it has received multiple user complaints, where there is evidence of fraudulent activity or scams, or where it has repeatedly violated these Terms. This decision is made at our sole discretion.
5. Messaging
Users may communicate with businesses through the App's messaging system. You agree not to send spam, harass other users, or use the messaging system for any unlawful purpose.
6. SOS / Panic Features
The SOS panic feature is provided as a convenience and does not guarantee emergency response times. Users select their preferred security company, and pressing the SOS button sends their name and approximate location to that company. The App operator is not liable for any delay or failure in emergency response.
7. Payments & Licences
Business owners may purchase licences and add-on services through the App. All fees are non-refundable unless otherwise stated. Invoices are issued via PayFast and must be paid within the specified period.
Where a transaction, licence, or account is subject to an unresolved complaint, dispute, suspected fraud or scam, or a chargeback, we may withhold or delay any related refund until our investigation is complete.
8. Prohibited Conduct
- Posting false, misleading, or fraudulent business information
- Harassing, threatening, or abusing other users
- Attempting to gain unauthorised access to the App or other users' accounts
- Using the SOS feature for non-emergency purposes (misuse may result in account suspension)
- Copying or reproducing any part of the App without written permission
9. Intellectual Property
All content, design, and code in the App are the property of bna-app and are protected by copyright and intellectual property laws.
10. Limitation of Liability
The App is provided "as is" without warranties of any kind. The App operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
13. Marketing & Third-Party Information Sharing
During sign-up you may optionally consent to your personal information (such as your name, email address, and phone number) being shared with selected third-party partners for their own marketing purposes. This consent is optional and is not required to create an account or use the App.
If you tick this option, you agree that we may share your details with those partners and that they may contact you with marketing offers. You may withdraw your consent at any time by contacting us, and we will stop sharing your details going forward. Our own service-related and account communications are governed separately and continue regardless of this choice.
